Conditions of Use

You agree to be bound by and comply with these Conditions of Use. All orders placed through this Site are also subject to our Terms of Sale, which govern credit accounts, retention of title, PPSA security interests, dispute resolution, and all other aspects of the trading relationship. Our Terms of Sale are available at https://www.ccg.co.nz/craft/pages/terms-of-sale. In the event of any conflict between these Conditions of Use and the Terms of Sale, the Terms of Sale prevail.
You agree to comply with all relevant laws relating to your use of the Site and the placement of any order through the Site.

You may order products by selecting and submitting an order through the Site in accordance with these Conditions of Use.
Any order placed through the Site is an offer by you to purchase the product at the price shown at the time you place the order (including delivery charges and taxes where applicable).
We may ask you to provide additional details or confirm your details to enable us to process your order. You agree to provide us with current, complete, and accurate details when asked to do so.

In certain circumstances, we may need to reject your order. This may happen where the requested product is not available or if there is an error in the price or product description on the Site. CCG is not liable for declining any order.
Each order placed through the Site that we accept results in a separate binding agreement between you and us for the supply of those products. CCG's acceptance of your order occurs when we issue an order confirmation. For each accepted order, we will supply the products in accordance with these Conditions of Use and our Terms of Sale, and provide you with an email confirmation.
If we reject an order, we will endeavour to notify you at the time of ordering or within a reasonable time after you submit your order.

If a product in your order is not in stock, we will use reasonable endeavours for 30 days to source the product ("Back Ordered Products"). We will notify you of the relevant Back Ordered Products and the anticipated delivery date. If we are unable to fulfil the back order within that period, we will notify you and you may cancel the affected item without penalty.

We deliver products ordered through the Site to locations where we provide delivery services. Delivery timeframes are estimates quoted in good faith and are not guaranteed. You can find more information about delivery timeframes and methods on our Shipping page.
If you do not want your parcel left unattended, please select the signature required option at checkout. This is especially recommended for high-value orders. Neither the courier nor CCG is liable for parcels that are stolen, damaged, or lost after delivery has been completed.
You acknowledge that any person at the delivery address who receives the products is authorised by you to receive your order. We may require the person accepting delivery to provide proof of identity. We also recommend that you be present to accept delivery if you have paid by credit card.
If your delivery is delayed beyond 10 working days of the expected date, we will notify you. If the delay exceeds 20 working days and your goods have not yet been despatched, you may cancel the affected order in writing without penalty.
Delivery may be delayed by events beyond our control, including natural disasters, pandemics, strikes, supply chain disruptions, or government action. We will keep you informed of any significant delays. If a delay continues beyond 60 days, either party may cancel the affected order without liability.

Risk of loss or damage to the products passes to you on delivery. Ownership of the products remains with CCG until payment in full or authorised resale in accordance with our Terms of Sale. For full details of CCG's retention of title and PPSA provisions, see our Terms of Sale.

All prices are in New Zealand Dollars (NZD) and include GST where applicable. The purchase price of each product is shown on the Site at the time you place your order. Prices on the Site may differ from in-store prices and we are not obliged to match any prices.
Prices may change from time to time without notice. Once we have accepted your order, the price will not change for that order (subject to our Back Orders policy above).
If you cancel an accepted order before despatch, we will refund any amounts paid less any reasonable directly incurred costs (such as restocking, shipping, and bespoke materials). Custom-ordered or imported-to-order products may be subject to additional cancellation charges as set out in our Terms of Sale.

You may pay for your order using the following methods: Visa, Visa Debit, Afterpay (subject to Afterpay's terms and conditions), or any other payment method made available on the Site.
Credit card payments may attract a surcharge not exceeding CCG's actual processing cost, disclosed before the transaction is processed.
If we are unable to successfully process your payment, we may cancel your order. You must not pay, or attempt to pay, for products through any fraudulent or unlawful means.
All transactions are charged in NZD regardless of any currency conversion display.

Please inspect your goods within 7 working days of delivery. If a product is damaged on delivery, you should refuse receipt and notify us through our customer service team. If you notice visible damage after delivery, you must notify us within 7 working days. If you do not notify us within that period, the goods will be deemed to have been received in good condition, subject to latent defect rights and the CGA.
Latent defects (faults not reasonably discoverable on inspection) must be notified to us within a reasonable time of the defect becoming apparent, and in any event within 6 months of delivery. Nothing in this clause limits your rights under the CGA or ACL, which may provide for a longer period depending on the nature and price of the product.
We do not offer refunds or exchanges for change-of-mind purchases. This does not affect your statutory rights under the CGA or ACL if a product is faulty, not fit for purpose, or does not match its description. See our Returns Policy for full details.
You must provide us with your order confirmation or invoice to make a claim under this clause. Refunds for Afterpay or other buy-now-pay-later purchases will be processed back through the original payment service.

Nothing in these Conditions of Use excludes or limits any rights you may have under the Consumer Guarantees Act 1993 (CGA) where goods are acquired for personal, domestic, or household use, or under the Fair Trading Act 1986. Australian customers may also have rights under the Australian Consumer Law (ACL).
To the maximum extent permitted by law, CCG excludes all implied terms and warranties, whether statutory or otherwise, relating to the Site or the products. You acknowledge that the Site is provided "as is".
Where any law implies a term that cannot be excluded, CCG's liability for breach is limited (at CCG's option) to: in the case of goods, replacement, supply of equivalent goods, or a refund of the purchase price; and in the case of services, resupply or payment of the cost of resupply.
CCG's liability is reduced to the extent that you cause or contribute to the loss or damage. CCG will not be liable for any indirect or consequential loss, including loss of profits, revenue, business, or opportunity.

We may immediately suspend, terminate, or limit your access to the Site and your account if you breach these Conditions of Use and the breach cannot be remedied, you fail to remedy the breach within 10 days of our notice, or there is an emergency.
We may stop making the Site (or any part of it) available without prior notice. Any accepted orders will not be affected unless the products are no longer available, in which case we will notify you and refund any payments received for those products.

We may update these Conditions of Use from time to time. Changes will be posted on this page. The conditions that apply to your order are those in effect at the time you place your order. We recommend you review these conditions each time you place an order. We will not change the terms for an existing accepted order.

We collect, hold, use, and disclose your personal information in accordance with the Privacy Act 2020. The manner in which we collect, hold, use, and disclose your personal information is set out in our Privacy Policy. You can view our Privacy Policy at [link to Privacy Policy page].
We collect your personal information through your use of the Site and through your personal contact with us. You agree for us to collect, hold, use, and disclose your personal information for the following purposes: providing our products and services to you in a secure way, including uses and disclosures required to operate the Site; sharing information with third parties who provide services to us in relation to online shopping, including delivery service providers and organisations that assist us with fraud prevention; credit assessment and debt collection purposes; and any other purposes to which you consent.
We will not use your personal information for direct marketing purposes unless you have consented. You may withdraw consent at any time by updating your account preferences, using the unsubscribe link in any marketing email, or contacting us directly.
You may access and request correction of your personal information by logging into your account or contacting us. We will respond within 20 working days. If you are not satisfied with our response, you may complain to the Office of the Privacy Commissioner at www.privacy.org.nz.
In the event of a privacy breach that has caused, or is likely to cause, serious harm to any affected individual, we will notify the Privacy Commissioner and the affected individuals in accordance with the Privacy Act 2020.
